How safe are my transactions?

Littlewoods Europe takes the security of your details very seriously. We use industry standard encryption methods to deter would be hackers. ‘Encryption’ turns your information into a special code that only Littlewoods Europe computers can unscramble.

All data provided through the Littlewoods Europe website is owned by Shop Direct Home Shopping Limited (“Shop Direct”). The Shop Direct group of companies ("the Group Company/Companies") also includes: Shop Direct Finance Company Limited (“SDFC”), which provides payment processing services;

Shop Direct Contact Centres Limited which provides enquiry-handling and other customer care services; and Home Delivery Network Limited, which provides or arranges delivery of the goods.  By giving information to Shop Direct you agree that it will be shared with Group Companies.

2. Ordering Goods

2.1 All orders are subject to these Terms and Conditions.

2.2 When you submit an order to us on our website, if the order can be processed, you will receive a 'bounce back' confirmation email of this order saying that we are processing your order and giving you estimated timescales for delivery, which will be within 30 days. You should check this email for accuracy and let us know immediately if there are any errors. If we are unable to process your order, we will send you an email advising you accordingly.

2.3 Promotional codes are codes that enable customers to obtain benefits such as discounts, free delivery and free gifts. These codes are non-transferable so may only be used by the person to whom they are issued and must only be used in accordance with their terms and conditions of use. If you use a promotional code to claim a promotional benefit, you must first check that it was issued to you and that you are eligible to use it. By using it to claim a promotional benefit you will be confirming that:-

3. Pricing and Product Descriptions

3.1 Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, the order will not be accepted and we will contact you with the correct details.

3.2 All prices shown on our website are inclusive of VAT. There is a standard delivery charge of €5 per order.

3.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a confirmation email.

3.4 Payment for all goods must be by credit or debit card or via your PayPal account. We only accept card payment by Visa, MasterCard and Delta.

4. Delivery

4.1 Delivery of goods ordered through this website can only be made in France, Germany, Portugal, Spain and the UK. We use a courier service to deliver the goods. Whilst we make every effort to deliver goods within the estimated timescales, delays are occasionally inevitable. We shall be under no liability for any delay or failure to deliver the products within the estimated timescales.

4.2 The website will indicate whether a product is available or is out of stock In the event that we are unable to supply the goods, we will inform you of this as soon as possible by email and any applicable refund will automatically be given. A refund will be given where you cancel the order but have already paid for the goods

4.3 When your items are delivered to you, you may be asked to sign for the goods to acknowledge that you have received them

4.4 Title to the goods will pass to you on delivery.

4.5 Please note that if you wish to return goods under our Approval guarantee, you have 28 days from receipt of the goods to return them to us. For further information on returns and exceptions to our home approval guarantee please see the Returns section.

4.6 If an item is faulty please email us at enquiries@littlewoodseurope.com  and we will arrange an appropriate remedy.

4.7 The terms “warranty”, “representation”, “guarantee” and “Home Approval Guarantee”  (regardless whether used in form of a noun or verb) shall not be interpreted as a guarantee under German law (including, but not limited to a guarantee in accordance with section 443 German Civil Code). A guarantee according to section 443 German Civil Code has to be agreed expressly and on a case-by-case basis between the parties to be effective.

8. Liability

8.1 We warrant to you that any goods purchased from us through this website will comply with their description on the website, are of satisfactory quality and reasonably fit for all the purposes for which goods of the kind are commonly supplied. We will compensate you by way of a [full] refund for any defect.

8.3 Save where your inalienable rights apply, our liability for losses you suffer as a result of us breaking this agreement is strictly limited to 125% of the purchase price of the goods you purchased and is limited to any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

8.4 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by circumstances outside our reasonable control. Such circumstances would include, by way of example only:-

8.4.1 Strikes or other industrial action.

8.4.2 Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

8.4.3 Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster..

8.4.4 Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

8.4.5 Impossibility of the use of public or private telecommunications networks

8.4.6 Failures of the suppliers of goods or any courier company to comply with contractual commitments

8.4.7 The acts, decrees, legislation, regulations or restrictions of any government

8.5 Our performance under any contract is deemed to be suspended for the period that such circumstances continue, and we will have an extension of time for performance for the duration of that period.  We will use our reasonable endeavours to bring the circumstances to a close or to find a solution by which our obligations under the contract may be performed despite those circumstances.

RETURNS

28-Day Approval Guarantee

The 28 day Approval Guarantee is offered at our discretion and is in addition to your statutory rights.

We will credit your credit/debit card account in respect of most items, provided they are returned complete, unused and in their original packaging, with any security tags intact, within 28 days of receipt. The goods will be charged to your credit or debit card when they are despatched to you. Returned garments must have their red label or hygiene strip still attached. We reserve the right to refuse to give a refund for goods, if you return them after the 28 day approval period (unless the goods are faulty) or if they are returned spoilt, damaged or otherwise unsellable. The approval period begins on the day you receive the goods and ends 28 days later. Returned goods must be sent by a safe and appropriate method to: Littlewoods Europe Returns, Raven Mill Returns Centre, Raven Avenue, Oldham OL9 8PW, UK. You will need to pay the cost of posting for the return of any goods (unless the goods are faulty).

Exceptions to our Approval Guarantee

Our Approval Guarantee does not apply to some items or may apply only if certain conditions are met. We will advise you of any applicable exceptions when placing your order. These items are clearly identified on the product page and any conditions are set out or referred to there. This does not affect your statutory rights. 

Your statutory right to cancel your order

For most items, you have the legal right to cancel your order within the 7 working days (14 working days for orders placed from Spain) starting with the day after you receive the goods (“the Cancellation Period”). However, this does not apply to certain items such as personalised products, perishable goods and audio or video recordings or computer software, which has been opened. If you wish to cancel using this right, you need to inform us in writing within the Cancellation Period. You must take reasonable care of the goods and immediately return them to us in the normal way. We will not consider that you have taken reasonable care of the goods, if they have been used in a way or to an extent beyond what would be reasonable when examining the goods in a shop before purchase. 

Faulty Goods

We warrant any goods ordered by you for 12 months from the date they are received by you. If any product we supply is in breach of clause 8.1 of the Terms and Conditions, we will provide you with a refund.  We may carry out any checks and tests we consider appropriate to establish whether the goods are faulty and notify you by email of our decision. We will process any refund as soon as possible and in any event within 30 days of the day we informed you via email that you were entitled to the refund.   Goods returned by you because of a defect will be refunded in full including a refund of the delivery charges for sending the item to you and any reasonable cost incurred by you in returning the goods to us.

This does not affect your statutory rights.

Promotional offers

All promotional offers, e.g. goods sold with free items, must be returned in their entirety. Failure to comply will result in you not receiving a full refund, as you will be charged the full price for the items you keep. 

Unacceptable returns

If you return an item to us outside the terms of our returns policy and Approval Guarantee and your statutory rights do not apply, we will not refund you. The item may be returned back to you at your expense which will be charged to your credit or debit card. You will be notified of this and other associated charges. If you send the item back to us again, or refuse to accept delivery, this will be deemed to be an irreversible instruction for us to dispose of your goods without further notice.  Disposal will not constitute any admission on our part that we have failed in any way to honour our obligations to you in full and will not constitute any unlawful action against the goods. 

Order Acceptance

Your order will be accepted by us, and a contract will then be formed between us, when we despatch the goods to you.
